Internet Banking Disclosure

This Internet Banking Disclosure explains the terms and conditions governing Personal Online Banking and Bill Pay Services offered by New Peoples Bank, Inc. ("the Bank"). All internet banking services of any kind offered by the Bank (including, but not limited to account inquiries, funds transfers, and bill pay services) will be referred to collectively as "Internet Banking Services" in the Disclosure. By using any of the Internet Banking Services, you agree to abide by the terms and conditions of this Disclosure and authorize the Bank to use any of your accounts to execute and settle transactions and/or fees initiated by you using the Internet Banking Services.

Business Day

The term "Business Day" means all days except Saturday, Sunday and all banking holidays.

New Peoples Bank Personal Online Banking Services

You may use your Personal Online Banking to perform the following functions:

  • View accounts - balances, rates, transactions, etc.
  • View images of checks
  • View account statements
  • Download your account information to various financial management software programs
  • Transfer funds between eligible accounts - one time transfer or recurring transfer - including payments on your New Peoples Bank loans
  • Set up the distribution of funds from your checking account to Payees that you designate to receive payment through NPB Bill Pay. Payments may be scheduled on an individual basis, or to occur automatically on a recurring basis.

All Internet Banking Services are governed by this Disclosure, applicable federal regulatory disclosures, and your various account Terms and Conditions. All applicable fee schedules published by the Bank from time to time will apply to the Internet Banking Services. You are responsible for the payment of any fees incurred by you on any account, for any service, at any time. You agree to pay all such fees assessed by the Bank. Further, you agree to pay access charges or fees incurred by you in accessing Internet Banking Services.

Use of any Internet Banking Services in connection with your account at the Bank constitutes your acceptance of this disclosure and your agreement to be bound by all of the terms and conditions of this Disclosure and of the Deposit Account Terms and Conditions. Such use acknowledges your receipt and understanding of this Disclosure.

Consumer Liability

The Bank is entitled to act upon instructions received through any Internet Banking Service under your ACCESS ID and PASSWORD ("personal access information") and without inquiring into the identity of the person using that personal access information. However, you agree that you will not, under any circumstances, disclose your personal access information by telephone or any other means to any person. You acknowledge that no person from the Bank will ever ask for your personal access information - that Bank employees do not need and should not ask for your personal access information. You agree never to provide your personal access information to anyone, including anyone claiming to represent the Bank. You are liable for all transactions made or authorized using your personal access information. The Bank has no responsibility for establishing the identity of any person or determining the validity of any transaction.

You agree that if you give your personal access information to anyone or fail to safeguard its secrecy, you do so at your own risk since anyone with your personal access information will have access to your accounts. You agree to notify the Bank in writing or by phone with follow-up in writing immediately in the event your personal access information is lost, stolen, or otherwise compromised. At any time, you may ask the Bank to disable your personal access information. In addition, you may change the password portion during any online session.

New Peoples Bank strongly encourages the use of a strong password. A strong password is defined as a password that is reasonably difficult to guess within a short period of time either through human guessing or the use of specialized software.

A strong password should:

  • Be at least 8 characters in length
  • contain upper and lowercase alphabetic characters
  • have at least one numerical character
  • have at least one special character

A strong password should not:

  • Spell a word or series of words that can be found in a standard dictionary
  • Spell a word with a number added to the beginning and the end
  • Be based on any personal information such as user id, family name, pet, birthday, etc.

Recommendations for maintaining a strong password:

  • Do not share your password with anyone for any reason
  • Change your password upon indication of compromise
  • Consider using a passphrase instead of a password
  • Do not write your password down or store it in an insecure manner
  • Avoid reusing a password
  • Avoid using the same password for multiple accounts
  • Do not use automatic logon functionality

For joint accounts, each person will have separate personal access information. Each person on a joint account will be liable for all transactions that are made on that account. Each person on a joint account authorizes all transactions made by any other persons on the account. Each person on a joint account agrees to be liable for the actions of the other person(s) on the account.

You hereby indemnify and release the Bank from any and all liability and agree not to make any claim against the Bank or bring any action against the Bank for honoring or allowing any actions or transaction where you have authorized the person performing the action or transaction to use your account or when you have provided your personal access information to that person. You agree to reimburse the Bank for any losses it suffers or any damages, injuries, costs or expenses it incurs (including attorney's fees) as a result of the Bank's honoring or allowing transactions on the account where the personal access information was used.

Procedures for Preauthorized Payments

Payments to any Payee may be made through NPB Bill Pay by electronic means or by draft mailed to the Payee. Individual payments may be scheduled.

Regularly recurring payments for the same amount, such as your mortgage or car payment, may be scheduled on the same day of each month. Regular payments in varying amounts may also be accommodated. If the regular payment day falls on a weekend or holiday, it is the consumer's choice whether it posts the day before or the day after the non business day.

Payments and other transactions conducted before 10 pm on a business day are posted as of that business day. Payments and other transactions conducted on a Saturday, Sunday or one of the Federal Holidays are posted the next business day. Recurring and future dated transactions will be posted to your account as of the business day such transactions are initiated. If your New Peoples Bank Personal Online Banking services are cancelled, either by you or us, all recurring and future dated payments will also be cancelled. Electronic payments made through NPB Bill Pay are generally received and credited by most payees within two (2) business days after the withdrawal date. Payments may be sent by paper check to some payees. All checks are sent through the United States mail. Payments made with a paper check are generally received and credited by most payees within five (5) business days after the withdrawal date. The Bank is not responsible for postal delays or processing delays by the payees. Occasionally, a payee chooses not to participate in the service, or may be unable to process payments in a timely manner. In such cases, we may decline to make future payments to these payees. It is the consumer's responsibility to schedule a payment sufficiently in advance of the due date so that the payment is received and processed in a timely manner. There is no guarantee of prompt receipt and processing of payments by payees. We are not responsible for any finance charges or late fees imposed, or other action taken, by a payee because of a late payment.

No Signature Required

When any payment or other on-line service generates items to be charged to your account, you agree that we may debit your account without requiring your signature on the item and without prior notice to you.

Consumer Responsibility

If your monthly statement shows any transfer, payment or other transaction which you or an authorized person did not make, TELL US AT ONCE. If you do not tell us within sixty (60) days after the statement is mailed to you, you may not be able to recover any of the money involved in this unauthorized loss.

Charges

Any fees for the New Peoples Bank Personal Online Banking services are provided in our retail fee schedule. We will provide you with notice of changes in this policy as required by law.

Disclosure of Account Information

We may and will disclose information to third parties about your account(s) or the transaction you make:

  1. Where it is necessary to complete the transaction(s);
  2. In order to verify the existence and standing of your account(s) with us upon the request of a third party, such as a credit bureau, or a merchant or other payee;
  3. If you give us your written permission; or
  4. In order to comply with government agency or court orders or other process, including our agency examinations and escheat reports.

Record of Transaction

You will receive a monthly statement showing the status of your account(s), including transactions that occurred during the past month. Transactions you have authorized through the Personal Online Banking Services will be indicated on the statement.

Overriding Law

The limitations of liability set forth in the Disclosure are subject to, and limited by any state or federal law to the contrary.

Disclosure Modification

The Bank has the right to modify or terminate this Disclosure at any time. When making changes, the Bank will comply with the legal notice requirements. If this disclosure is modified, your continued use of the Account will represent your acceptance of the changes.

Termination of Services

Once the bank has terminated your use of Internet Banking Services, the Bank will not allow any additional transactions on the account, nor will additional Internet Banking Services be permitted.
