Electronic Delivery of e-Statement/e-Notices/NPB Alerts
Unless you consent, you have the right to receive all required disclosures in paper or non-electronic form. By accepting the “New Peoples Bank Inc. Electronic Account(s) Disclosure Agreement”, you consent and agree that New Peoples Bank Inc. may provide certain disclosures, notices and alerts to you in electronic form, in lieu of paper form, including electronic delivery of e-Statement/e-Notices/NPB Alerts for your New Peoples Bank Inc. account(s).
Consent Agreement for Electronic Signatures, Records, Disclosures and Communications
This E-Sign Consent Agreement ("Agreement") for the use of Electronic Signatures, Records, Disclosures and Communications. This Agreement allows us to provide you with electronic versions of important notices and documents associated with opening and managing your account(s) at New Peoples Bank, Inc. Certain laws and regulations require us to provide notices and disclosures to you in "writing" (traditionally this is defined as a paper notice); with your consent, the E-SIGN Act allows us to provide these documents to you electronically.
"We," "us" and "our" means New Peoples Bank, Inc., and each and every current and future affiliate of New Peoples Bank, Inc.
"You" and "your" means the person giving this E-Sign Consent, and also each additional account owner, authorized signer, authorized representative, delegate, product owner and/or service user identified on any account, product, or service that you apply for, use or access. If the account is owned jointly, any one of you may consent to receive Electronic Records and that election will apply to all accountholders. Email notices will be sent to one account owner, but statements can be accessed by all online banking users.
"Communications" means each disclosure, notice, agreement, fee schedule, statement, record, document and other information we provide to you, or that you sign or submit or agree to at our request.
You agree that the Communications we provide to you, or that you sign or agree to at our request may be in electronic form ("Electronic Records"). We may also use electronic signatures and obtain them from you as part of our transactions with you.
Scope of Agreement
Your consent covers all Communications relating to each and every account, product or service we offer that you apply for, own, use, administer or access, either now or in the future, including but not limited to loan application(s), loan request(s), approval process(es) and other loan documentation. Your consent remains in effect until you give us notice that you are withdrawing it. Please read this notice carefully before giving consent.
Change of Mailing Address, Email Address, and Other Information
You agree to notify us immediately of any change in your mailing address, e-mail address or other particulars relevant to this Agreement. To notify us of your address change, please visit your nearest branch location or login to your personal online banking account at newpeoples.bank, go to top right and select profile, then select edit address/email address, and enter your new address in the appropriate fields. Please note that you must provide us with an e-mail address in order to use the e-Statement/e-Notices/NPB Alerts service.
You agree that New Peoples Bank Inc. shall not be held liable if you are unable to gain access to your email, the website or New Peoples Bank, Inc. Online Banking system from time to time or if your account has been blocked or deactivated. You understand that some or all of the E-Statements/E-Notices/NPB Alerts services and/ or other New Peoples Bank, Inc. system services may not be available at certain times due to maintenance and/or computer, communication, electrical or network failure or any other causes beyond New Peoples Bank, Inc.'s control. You understand the importance of your role in preventing the misuse of your accounts and you agree to promptly examine your e-Statement/e-Notices/NPB Alerts for each of your New Peoples Bank, Inc. account(s) as soon as you can access it. You must report any errors or discrepancies in accordance with our Account Disclosure as provided to you and with applicable law.
Hardware and Software Requirements
Below are the hardware and software requirements to access and retain Electronic Records. We will notify you whenever we change or revise these requirements:
Change in Terms
We reserve the right to change the terms and conditions of this Agreement at any time upon posting to our web site at newpeoples.bank or sending you an electronic Communication or similar written notice. Your continued use of our products and services after such notification of change shall be understood as your agreement to be bound by all such changes.
Right to Withdraw Consent
You have the right to withdraw your consent to have your Communications provided in an electronic form by contacting your local branch. We will then discontinue all electronic Communications and you will receive all documents in paper form. If you want to receive electronic Communications, again after you have withdrawn your consent for electronic Communications, you must complete the consent process again and reconfirm your ability to access the electronic Communications.
Requesting Paper Copies
You agree and understand that paper versions of electronically presented documents may not be mailed unless you specifically request them. To request a paper copy of any of the Electronic Records, Disclosures, Notices, Agreements, Fee Schedule, Statements and Communications, contact us at 1-276-873-7000. Copies will be mailed and a charge for paper copies may apply.
Disclaimer of Warranty and Limitation of Liability
WE MAKE NO WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, IN CONNECTION WITH THE DELIVERY OF ELECTRONIC RECORDS PROVIDED TO YOU UNDER THIS AGREEMENT. WE DO NOT AND CANNOT WARRANT THAT OUR DELIVERY OF ELECTRONIC RECORDS WILL OPERATE WITHOUT ERROR, OR THAT IT WILL BE AVAILABLE AT ALL TIMES. YOU AGREE THAT OUR SHAREHOLDERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR CONTRACTORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH ANY COMMUNICATIONS, SERVICES OR PRODUCTS PROVIDED UNDER THIS AGREEMENT OR BY REASON OF YOUR USE OF ANY SUCH ANY COMMUNICATIONS, SERVICES OR PRODUCTS, INCLUDING LOSS OF PROFITS, REVENUE, DATA OR USE BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT OR BASED ON A WARRANTY OR ANY OTHER LEGAL THEORY
